TERMS & CONDITIONS

All claims for damaged material must first be made to the carrier and then to Take Control LLC within 24 hours of receipt of the merchandise. Buyer shall notify Seller in writing, within 24 hours after delivery, of any nonconforming items of Property or any deficiencies or shortages. Otherwise, all such claims shall be deemed waived by Buyer. The use by Buyer of any Property claimed to be nonconforming or deficient shall constitute acceptance of such items by Buyer. Unless Seller otherwise specifically agrees, Buyer shall have no right to withhold payment of the purchase price or to adjust the amount of the purchase price because of any such claim. 

RETURN POLICY AND RETURN INFORMATION

All sales are final. Return of any product must be authorized and return shipping will be buyers responsibility. Take Control LLC reserves the right to charge a restocking fee of 25% on returns, other than defective merchandise or shipping errors. In the rare event an item is missing or received damaged, please notify Take Control LLC. Special order and non-stocked items are considered NOT RETURNABLE to Take Control LLC. Take Control LLC will be subject to the terms and conditions from our suppliers, including freight charges. Upon receipt of a returned item, TakeControl LLC will issue, at our discretion, a credit or replacement. Take control LLC is not the manufacturer of the products distributed. Representations as to the fitness of the various products for certain specified purposes are solely that of the individual manufacturer. Take Control LLC makes no warranties of any kind and disclaims any expressed or implied warranty, including warranties or merchantability and fitness for a particular purpose arising out of or in connection with the sale, manufacture, delivery or use of any product sold by Take Control LLC. In no event shall Take Control LLC be liable for any claim for incidental consequential damages arising out of connection with the sale, delivery, or use of any product sold by Take Control LLC. No acceptance, deposit or banking of funds by buyer shall constitute an accord and satisfaction, regardless of any notations, such as payment in full placed on the check, remittance, or accompanying by the buyer. If net 30 terms are granted, a service charge of 3% per month, will be charged to accounts which are unpaid after 30 days. Service charge will continue to accrue, if not paid in the current month. Acceptance by Take Control LLC of any payment, shall not constitute a waiver of service charges. If action is instituted to collect this invoice, Buyer shall have no right of setoff hereunder, the same being expressly waived hereby, after Seller obtains judgement against Buyer. Seller expressly reserves its right to file liens in the ordinary course of business per applicable law and expressly disclaims any request for a waiver of lien rights by Buyer. The Buyer agrees that any legal action arising under or related to this agreement shall be brought in Oklahoma County, Oklahoma, and any right to object to such venue or to assert the inconvenience of such forum is hereby waived. The Buyer waives all rights to a jury trial. Buyer and seller agree that this agreement constitutes a conditional sales contract and that title to the merchandise set forth on the reverse side remains with the Seller until fully paid by the Buyer.
